Cartel Ruling Upheld

The Full Federal Court of Australia has upheld the ruling against Prysmian’s cartel conduct and has dismissed their appeal.

“The ACCC is committed to pursuing cartel conduct, which can cause significant harm to consumers, other businesses, and the competitive process the economy depends on,” said ACCC Chair, Rod Sims.

In their appeal, Prysmian argued the judge made a mistake, since one of the other alleged participants in the cartel conduct had their case dismissed. They also argued there were ‘errors’ in the judge’s reliance on witnesses.

In 2016, it was found that Prysmian ”…entered into and gave effect to agreements involving price guidance to competitors and project allocation.”
